These Terms of Service (the "Agreement") are an agreement between Cyber Cast International, S.A. ("CCIHosting.com" or "us" or "our") and you ("User" or "you" or "your" or "Customer"). This Agreement sets forth the general terms and conditions of your use of the products and services made available by Cyber Cast International, S.A., and of the CCIHosting.com website (collectively, the "Services"). By using the Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Services. Cyber Cast International, S.A. reserves the right to make changes to the provided Agreement as needed, without notice to our clients. Modification made to the terms does not constitute early contract termination or non-payment.
Use of the Services is also governed by the following policies, which are incorporated by reference. By using the Services, you also agree to the terms of the following policies.

The present Agreement is subject to the law of the Republic of Panama. The Service and any data you provide to Cyber Cast International, S.A. is subject to the law of the Republic of Panama.
Cyber Cast International, S.A. is committed to protecting the privacy of its Customers. We will not give any personal or corporate information to anyone other than the Panamanian Government through a formal request without further consent or notification to the Customer. Any other request for information of our Customers will be discarded.
Customers agree that for each domain name registered with ID Protection Service the domain will be registered under Top Level Domains, S.A., a Panamanian corporation offering private domain registration service.
To transfer a privately registered domain name away from our registrar, you need to do the following:
On the Service Commencement Date for each Service, the Customer will be billed an initial amount equal to all non-recurring charges (Setup Fee if any) and the monthly, quarterly, semi-annual, or annual Fee. Subsequent recurring charges will be billed in advance one day earlier of the Service anniversary based on its term. Customers that use Credit Card (Visa, MasterCard) and PayPal agree to automatic recurring charges. All other charges for Services received and expenses incurred for Supplemental or Professional Services during the period (e.g., Paid Support) will either be billed immediately or within the period in which the Services were provided. Bandwidth overage billing is calculated and invoiced independently from the related Service on the last day of the month. In bandwidth overage, Cyber Cast International, S.A. will charge its Customer $0.15 USD for every additional Gigabyte of data transferred or received.
Cyber Cast International, S.A., will send any invoices to the primary email account of the Customer based on the service terms. Cyber Cast International, S.A. cannot guarantee that the client will receive this email. As an option, we provide the Client a Billing Panel (Clients Portal) where the invoices can be reviewed and paid. The client can add additional billing contact from the Billing Panel (Clients Portal).
Only applies for new Shared Hosting accounts paid for (3) three months or more in advance and invoice paid via Credit Card or PayPal and if the account is canceled within 30 days from the initial order date. Month-to-month subscriptions are not eligible for refunds. Once 30 days from the initial order's date have been over, a full refund, partial refund, or prorated refund is no longer applicable.
Any prepayment is a commitment regarding the payment period that cannot be refunded outside the "30-days Money Back Guarantee Policy". Any available credit in the Customer account cannot be refunded but may be used to pay new services or pending invoices.
Billing errors can be credited retroactively for a period of up to two (2) months.
Cyber Cast International, S.A. will not issue refunds for dedicated server packages, virtual private server (VPS) packages, cloud servers, domain name registration fees, domain name registration ID Protection fees any software license paid support, SSL certificates, DDoS attack protection services, Service were the Customer victims of DDoS attack, setup fees, shipping and handling fees, internet bandwidth, or any additional features ordered.
There is no refund if you fail to cancel your PayPal subscription, even after account cancellation is completed. Cyber Cast International, S.A. is not responsible for canceling the subscription on behalf of the subscriber.
The following payment methods are non-refundable, and funds may be credited to the client account: Bitcoin or any other cryptocurrency, Bank Wire Transfer, local and international checks, cash deposits.
Any payment not received within four (4) days of the invoice due date, Cyber Cast International, S.A. reserved the right to suspend the account without notice. If after fifteen (15) days of not receiving a payment confirmation Cyber Cast International, S.A. reserved the right to terminate the account without further notice. At this point, any data, email, files stored in our servers will be deleted. During the suspension period of shared hosting service, the Customer's Website may be replaced by a temporary web page announcing the Website suspension status and displaying advertisements unrelated to the Customer's Website.
To terminate a service, the Customer must cancel via the Billing Panel (Clients Portal) at Cients Portal.
In the case of a written Agreement, a formal letter should be added to the cancellation request 30 days in advance.
In the case of Credit Card subscription cancellation, you must send an email to billing@ccihosting.com requesting to remove your credit card details from the system. We cannot and will not be responsible for unintended payments made using the automatic payment subscription service.
In the case of PayPal subscriptions, in addition to requesting cancellation via our Billing Panel at Billing Panel, you must cancel any active PayPal recurring payment subscriptions by login into your PayPal account and request the cancellation directly to PayPal. As Cyber Cast International, S.A. does not have access to the client's PayPal account, we cannot and will not be responsible for unintended payments made using the automatic payment subscription service.
Canceling your account removes any data, email, files stored in our servers. Be sure that you have copies of any files you want to keep before you cancel your account.
Cancellation requests via email, phone calls are not considered valid account cancellation procedures.
It is defined as any scheduled interruption of Services for network upgrades or replacement of any equipment to provide the Customer a reliable service. Scheduled downtime occurs during notified downtime periods, with as much advance warning as possible via email with a minimum of 24 hours. Downtime caused by scheduled network upgrades will not be eligible for refund or credit.
Cyber Cast International, S.A. is committed to offering First Level technical support to all our Service 24 hours via ticket system opened at Billing Panel (Clients Portal) and via Live Chat at our website. Phone support is available from Monday to Friday from 9 AM to 5 PM GMT -6. The Customer should open a support ticket before issuing a support phone call.
The initial ticket response is 1 hour, and further communication may take longer depending on ticket difficulty or conditions.
Paid support is charged per incident starting at $50 USD.
The Customer represents and warrants that is at least eighteen (18) years of age. The Customer possesses the legal right and ability to enter into this Agreement. The performance of its obligations and use of the Services (by Customer, its customers, and users) will not violate any applicable laws or regulations or cause a breach of the Agreement. The Customer assumes all risks related to the processing of transactions related to electronic commerce.
This Agreement does not transfer from Cyber Cast International, S.A. to Customer any Cyber Cast International, S.A. Technology, and all right, title and interest in and to Cyber Cast International, S.A. Technology will remain solely with Cyber Cast International, S.A. This Agreement does not transfer from Customer to Cyber Cast International, S.A. any Customer Technology, and all right, title, and interest in Customer Technology will remain solely with Customer. Cyber Cast International, S.A., and Customer agree that it will not, directly or indirectly, reverse engineer, decompose, disassemble or otherwise attempt to derive source code or other trade secrets from the other party and/or its third-party vendors.
Your use of the Services is at your sole risk. Included backup Service runs once a day and overwrites any of our previous backups. Only the last three (3) days of backups are kept at a time. This Service is provided only to shared hosting, and OpenVZ VPS accounts as a courtesy and may be modified or terminated at any time at Cyber Cast International, S.A. sole discretion. Cyber Cast International, S.A. does not maintain backups of dedicated accounts. Cyber Cast International, S.A. is not responsible for files and/or data residing on your account. You agree to take full responsibility for all files and data transferred and maintain all appropriate backup files and data stored on our servers.
Cyber Cast International, S.A. shall not be responsible for any damages your business may suffer. Cyber Cast International, S.A. Service warranties are specified in its Service Level Agreement located at http://www.ccihosting.com/service-level-agreement.html.
Cyber Cast International, S.A. does not and cannot control the flow of information to or from Cyber Cast International, S.A. network, and other portions of the Internet. Such flow depends in large part on the performance of Internet services provided or controlled by third parties. At times, actions or inactions of such third parties can impair or disrupt the Customer's connections to the Internet (or portions thereof). Cyber Cast International, S.A. cannot guarantee that such events will not occur. Accordingly, Cyber Cast International, S.A. disclaims any liability resulting from or related to such events.
The Services are provided on an 'as is' basis, and the Customer's use of the services at its own risk. Cyber Cast International, S.A. does not make, and hereby disclaims, any and all other express and/or implied warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement, and title, and any warranties arising from a course of dealing, usage or trade practice. Cyber Cast International, S.A. does not warrant that the services will be uninterrupted, error-free, or completely secure.
